What is a perineal tear claim?
A perineal tear is an injury to the perineum (the area of skin between the anus and vagina) that is sustained by a woman giving birth vaginally. There are different degrees of tear. 3rd and 4th degree tears are both severe injuries that extend to the anal sphincter complex.
A perineal tear claim is when a patient suffers a perineal tear but the injury is negligently managed by medical practitioners. This can cover a host of situations, such as:
- The tear is not diagnosed
- The tear is repaired to a poor standard
- The tear is caused by the actions of medical staff – e.g. a midline episiotomy
- The tear becomes infected but is not treated
- Can I claim for a perineal tear?
If you think that your perineal tear was not properly diagnosed, treated, managed, or was caused by medical error, you need to speak to a solicitor.
A solicitor will ask you about the care you receive while giving birth and after you were discharged from hospital. You will also be asked about the symptoms you have experienced since and what has been said at any follow-up appointments (for instance, whether you have now been diagnosed with a missed tear).
After considering your case, the solicitor will contact you to say whether or not you are eligible to pursue a compensation claim. If so, you need to decide if you wish to proceed.

Medical negligence compensation claims must be made within three years of the negligent incident, which will most likely be the birth date of your child. This time limit means it is important to seek legal advice without delay, or you could run out of time.
